Your use of the Site, Materials, Software, and Interactive Services (collectively, the “Content”) is subject to these Terms. By accessing or using the Site or Content, you confirm that you have read, understood, and agree to be bound by these Terms.

Failure to make timely payments may result in suspension or termination of your Account.

  1. Intellectual Property Ownership of Inspect360 IP

All intellectual property rights in the Inspect360 platform, including but not limited to software, code, features, trademarks, domain names, and proprietary methodologies, are the sole and exclusive property of Creative Cloud ltd Trading as Inspect360

Users acknowledge that they do not acquire any ownership rights by using the Site or Service. Any unauthorized use, copying, reverse engineering, or reproduction of Inspect360’s IP is strictly prohibited and may result in legal action.

You agree not to:

  • Copy, modify, distribute, or create derivative works of the Content;
  • Reverse-engineer or attempt to extract the source code of our Software;
  • Use our intellectual property for commercial purposes without our written permission.

Inspect360 grants you a limited, non-exclusive, non-transferable license to use the Site for business purposes only.

  1. User Content

By submitting, uploading, or posting content (“User Content”) to the Site, you:

  • Grant Inspect360 a worldwide, royalty-free, perpetual license to use, reproduce, and distribute your User Content;
  • Warrant that you own or have the necessary rights to post such content;
  • Agree that Inspect360 may remove any User Content that violates these Terms or applicable laws.

Inspect360 is not responsible for User Content posted by others.

  1. Prohibited Conduct

You agree not to use the Site or Content to:

  • Engage in fraudulent, illegal, or deceptive activities;
  • Post or distribute offensive, defamatory, or infringing material;
  • Interfere with the operation of the Site, including hacking or introducing malicious code;
  • Attempt to gain unauthorized access to our systems or another user’s Account.

Violations of this section may result in immediate termination of your Account and potential legal action.

  1. Third-Party Services

The Site may contain links to third-party services, including payment processors and integration partners. Inspect360:

  • Does not control third-party services;
  • Is not responsible for their availability, functionality, or data practices;
  • Does not endorse third-party content or services.

Your use of third-party services is subject to their own terms and conditions.

  1. Disclaimers and Limitation of Liability

The Site and Content are provided “as is” without warranties of any kind, including:

  • No warranty of accuracy: We do not guarantee the accuracy, completeness, or reliability of our Content.
  • No warranty of uninterrupted service: We do not guarantee that the Site will always be available, secure, or error-free.

To the fullest extent permitted by law:

  • Inspect360 is not liable for any indirect, incidental, or consequential damages;
  • Inspect360’s total liability under these Terms is limited to the amount you have paid for services in the past six months, or £100, whichever is less.

Some jurisdictions do not allow exclusions of certain warranties, so these limitations may not apply to you.

  1. Indemnification

You agree to indemnify and hold harmless Inspect360 Ltd, its officers, employees, and partners from any claims, damages, losses, or legal fees arising from:

  • Your use of the Site;
  • Your violation of these Terms;
  • Your infringement of third-party rights.

Inspect360 reserves the right to:

  • Terminate or suspend your Account at any time, with or without notice;
  • Remove or restrict your access to the Site;
  • Delete User Content that violates these Terms.

  1. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales. Any dispute arising from or relating to these Terms shall be resolved exclusively in the courts of England and Wales.
